Law as of October 28, 2026 · [Reviewed by Sergio Maldonado Elvira on 29 October 2026](https://dposchool.com/state-privacy-laws/about#review)

## Summary (not the statute text)

The Department of Justice enforces the Act exclusively, and there is no private right of action. The mandatory 60-day cure period applied only in 2025; since 1 Jan 2026 a cure opportunity is discretionary. A violation is an unlawful practice under the consumer fraud law, which allows civil penalties of up to $10,000 for each wilful violation.
