# Indiana privacy law (ICDPA): controller duties

Law as of October 28, 2026 · [Reviewed by Sergio Maldonado Elvira on 29 October 2026](https://dposchool.com/state-privacy-laws/about#review)

## Summary (not the statute text)

Controllers must limit collection to what is adequate, relevant and reasonably necessary, keep reasonable security, and publish a privacy notice. Indiana does not require controllers to honour universal opt-out signals. Data protection impact assessments are required for targeted advertising, sale, risky profiling, sensitive data and other high-risk processing created after 31 Dec 2025.

## Key points

2. No processing for purposes neither reasonably necessary for nor compatible with the disclosed purposes without consent.

   Section: [IC 24-15-4-1(2)](https://iga.in.gov/ic/2026/Title_24.pdf)

5. No universal opt-out signal duty appears in the Act.
